Legal practice focuses on construction and government contract litigation.

Also represents clients in contract negotiations and disputes relating to power production and energy related construction projects. Litigation counsel for various parties in a wide variety of construction related disputes before the Boards of Contract Appeals, federal and state trial and appellate courts, and arbitration panels.

Client Work

  • Successfully represented numerous government contractors in the defense of False Claims Act and related fraud and debarment actions; negotiation of Corporate Integrity Agreements and development and implementation of corporate compliance programs.
  • Represent owners/developers in negotiation and drafting of EPC contracts and major equipment purchase agreements for domestic power generation projects throughout the United States. Also counsel these clients on contract administration and claim prosecution and defense.
  • Lead litigation counsel for EPC contractor in arbitration and successful mediation of claims for contract changes, delays, disruption, acceleration and defective work on 1,000 MW power plant project.
  • Litigation counsel for mechanical contractor's successful claim for labor inefficiency and defective specification claims against General Services Administration on NOAA laboratory and office facility project in Boulder, Colorado. Client was awarded substantially all of the inefficiency and extra costs sought by the contractor.
  • Lead litigation counsel for contractor in successful claims for labor inefficiencies and defective specifications on fixed mechanization systems retrofit project at U.S. Postal Service mail processing center in Chicago.
  • Lead litigation counsel for general contractor on claims against the U.S. Postal Service for acceleration, labor inefficiency, and differing site conditions.
  • Lead litigation counsel for municipal owner in successful arbitration defense of contractor delay, acceleration and inefficiency claims arising out of construction of waste-to-energy facility.
  • Lead counsel to electrical subcontractor on commercial office tower project in downtown Los Angeles in litigation of claims against general contractor and owner for acceleration, schedule disruption, and fraudulent misrepresentation. Case was resolved favorably to client after mini-trial before a retired Superior Court Judge.
  • Successfully defended general contractor in litigation and arbitration of owner's claims for structural failure and in litigation and negotiations with contractor's general liability carrier for reimbursement of litigation costs.
